China Addendum

This China Addendum (“China Addendum”) applies to the collection and processing of your personal information by Applied Materials (China), Inc. and its affiliates (“Applied Materials,” “us” or “we”) if you are located in the People’s Republic of China (“China”) and supplements the Privacy Policy. In case of any inconsistencies between this China Addendum and the rest of the Privacy Policy, this China Addendum prevails.  We collect and process your personal information in compliance with applicable Chinese laws.

For job applicants located in China, our Candidate Personal Information Protection Notice also applies to you.

  1. Collection and Use of Sensitive Personal Information

    Information regarding any of your financial accounts may be considered sensitive personal information.  Applied Materials processes such information only as necessary to facilitate dealings or transactions with you.  We will adopt strict security measures when processing your sensitive personal information.

  2. Sharing of Personal Information with Third Parties

    As described in the Privacy Policy, we may share your personal information with service providers and agents that will process the information on Applied Materials’ behalf for purposes such as to provide services or products you have requested, perform billing and collection, or help us manage and analyze data and improve our Websites.  In addition, we may disclose your personal information to third parties when we believe disclosure is necessary to: (i) comply with a law, regulation or compulsory legal process, including a law enforcement, regulatory or court-authorized request; (ii) protect the rights, property, or safety of Applied Materials or other persons or entities; or (iii) enforce our Website Terms of Use.

    We require all third parties receiving your personal information to implement appropriate measures to protect your personal information.  When using external service providers, we will require them to process your personal information only for purposes set out in this Privacy Policy, the China Addendum, and the Candidate Personal Information Protection Notice.

    If we need to transfer personal information due to a merger, division, dissolution, declaration of bankruptcy, or other reasons, we will notify you of the name and contact information of the recipient.  To continue performing the obligations as described in the Privacy Policy and China Addendum and otherwise, the recipient shall obtain your consent.

  3. Cross-border Transfer of Personal Information

    Applied Materials is a global company which has legal entities in several countries.  Please see here for a detailed list.  To provide you with products and services, fulfill legal obligations or achieve other purposes provided in this Privacy Policy and China Addendum, Applied Materials may transfer your personal information to our global entities outside of China.  You agree that we can transfer your personal information overseas in accordance with the purposes as specified in this Privacy Policy and China Addendum.  If applicable Chinese laws require us to provide you with further notice and obtain your separate consent for the cross-border data transfer, we will further provide such notice and obtain your separate consent.

    We will use a lawful cross-border transfer mechanism to transfer your personal information overseas and adopt necessary measures to ensure the overseas recipients can provide the same level of protection as required under applicable Chinese laws.

  4. Retention and Security of Personal Information

    Applied Materials only keeps personal information for as long as it is necessary to accomplish the purposes for which it was collected, except where applicable laws and administrative regulations stipulate otherwise.

    We use technical, administrative, and physical measures to protect your personal information.  In case a security incident occurs, we will take remediation actions immediately and notify relevant government agencies and affected individuals, when required by applicable Chinese laws

  5. Personal Information Rights

    You have the following rights with respect to your personal information that Applied Materials collects and uses:

    • Right to access and obtain a copy of your personal information: You have the right to request that we provide you with access to or a copy of your personal information unless otherwise specified by applicable Chinese laws;
    • Right to portability: You have the right to request that we transfer your personal information to entities appointed by you in accordance with the requirements as set out under applicable Chinese laws;
    • Right to rectification: If your personal information is inaccurate or incomplete, you may request that we update and rectify your personal information;
    • Right to erasure: You may ask us to delete your personal information if one of the following conditions is satisfied:
      • The purpose of the processing has been achieved, is impossible to achieve, or it is no longer necessary to achieve the purpose of processing;
      • The retention period ends;
      • You have withdrawn your consent, if we rely on your consent to process your personal information; and
      • We violate laws or administrative regulations when processing your personal information;
    • Right to request explanation: You may request that we explain how Applied Materials processes your personal information;
    • Right to object to and restrict processing: You may ask us to stop or restrict our processing of your personal information, such as where you contest the accuracy of the data or object to us processing it - unless our processing of your personal information is necessary for your employment or is mandatorily required under applicable laws; and
    • Right to withdraw consent: If we rely on your consent to process your personal information, you have the right to withdraw consent to future processing at any time.
